The Kadi Litigation and the Rule of Law in the Context of Sanctions

JUSTICE invites you to join us for this panel discussion on the Rule of Law and its applicability in the context of targeted sanctions.

This expert panel of speakers will explore the legal action taken by Saudi businessman and philanthropist Sheikh Yassin Abdullah Kadi in the aftermath of the September the 11th attacks; including his ground-breaking litigation which led to landmark decisions concerning the inter relationship between international and EU law.

The discussion will also cover the petition Mr Kadi brought before the UN Ombudsperson Judge Prost appointed under the UN’s 1267 sanctions regime ; and important administrative challenges Mr Kadi brought in respect of restrictive measures imposed on him by the US.

Following 9/11 the response of the US and the British governments to the threat of Al Qaeda posed unique challenges to the established legal order. The conference will examine the issues raised through a thorough and interactive discussion. This will include a review of how the liberalising legal principles established in Mr Kadi’s case are applicable now in the contemporary environment of targeted sanctions, particularly in relation to Russia.

Bios:

  • Lord David Anderson KC
    • David Anderson (Lord Anderson of Ipswich KBE KC) is a barrister at Brick Court Chambers and an active cross-bench peer. Highlights of his sanctions practice include appearances for the successful claimant Sheikh Yassin Abdullah Kadi in his challenge to EU restrictive measures (2005 – 2010), and for Eugene Shvidler in his challenge to UK designation, which will be heard by the Supreme Court in January 2025. Between 2011 and 2017, his reports as the UK’s Independent Reviewer of Terrorism Legislation have been influential on legislation, notably in the fields of counter-terrorism and investigatory powers.
  • Judge Kimberly Prost
    • Judge Kimberly Prost is a judge of the International Criminal Court (ICC). From 2010 to 2015, Prost was the first Ombudsperson of the UN Security Council 1267 Al-Qaida Sanctions Committee, tasked with advising the Committee and making recommendations on requests from individuals or organizations who are subject to global sanctions, as a result of "listing" by this committee.
  • Guy Martin
    • Guy Martin is Head of the International Law practice at Carter-Ruck, and a leading practitioner and expert in complex litigation in the fields of Public International Law, European Law and Human Rights, in the courts of the UK, EU, the US and the UN. Since October 2001, Mr Martin has represented Saudi businessman and philanthropist Sheikh Yassin Abdullah Kadi, including in his two successful appeals to the European Court of Justice, where the first judgment led to the creation of the Office of the Ombudsperson by the UN Security Council.
  • Richard Barrett
    • Richard Barrett is a former British diplomat and intelligence officer, former Chair of the Expert Monitoring Group of the UN 1267 Committee and recognised global expert on terrorism. Mr Barrett's experience in the field of counter-terrorism includes leading the Monitoring Team of Experts that supports the United Nations Security Council Committee pursuant to resolution 1267 (1999) concerning Al-Qaida and associated individuals and entities, chairing the CTITF Working Group on Terrorist use of the Internet and the CTITF Working Group on Dialogue Understanding and Countering the Appeal of Terrorism, and much more.
