Horizon 2020
The Open Research Data Pilot scheme encourages the open access and reuse of research data generated by Horizon 2020 projects. In 2017 the pilot was extended to cover all thematic areas within the Horizon 2020 programme, although projects do have the option to “opt out” if there are legitimate reasons why the data cannot be made open access.
Horizon Europe
'Under Horizon Europe (Work programmes 2021 and onwards), it is not possible to opt out completely [from ERC open research data obligations], but exceptions to the requirement to provide open access to data and metadata are possible.' (Information for ERC grantees, p.4)

- Where to archive? In a ‘trusted’ repository which allows for encoding of appropriate metadata.
- How long for? 'A substantial period — at least five years, and preferably 10 years or even longer'.

See the NIHR position on the sharing of research data and policy on Open Access, which include a requirement that "data sharing statements must be included when publishing the findings of the research describing how to access the underpinning research data", and that data management plans "must be completed during the startup of the research".
In addition, the data sharing policy of the NIHR Journal Library requires all authors generating data derived from patient or public participation to submit a data access statement when publishing their final report.
